Federal Chemical-Specific Requirements Safe Drinking Water Act This law establishes treatment standards GW, VZ X[b] X[b] (SDWA) for current potential drinking water sources by [42 USCA 300] setting Maximum Contaminant Levels (MCLs) and [40 CFR 141.11-141.16; non-zero Maximum Contaminant Level Goals (MCLGs), X[b] 141.50-141.51] which are used as cleanup standards. Those standards for the LLNL site are listed in Table 1 of the ROD. Clean Air Act (CAA) National primary and secondary ambient air GW, VZ X[c] [42 USCA 7401-7642] quality stecondary ambient air quality standards X[c] [40 CFR 50-69] (NAAQS) are defined under Section 109 of the CAA and are listed in 40 CFR 50. Clean Air Act National Emission Standards for Hazardous Air GW, VZ X[c] [42 USCA 7412] Pollutants (NESHAPs) are specific to industrial X[c] [40 CFR 61.92] emissions. 40 CFR 61.92 limits emissions of radionuclides to those amounts that would cause any member of the public to receive, in any one year, a maximum effective dose equivalent of 10 millirem per year.
Federal Action-Specific Requirements Action: Closure Resource Conservation Requires that a facility be closed in a manner GW, VZ X[b] Recovery Act (RCRA) which minimizes the need for further maintenance X[b] 42 USCA 6901 and is protective of human health and the [40 CFR 264.111] environment. Applicable to hazardous waste management facilities. RCRA Requires removal of all hazardous waste and waste GW, VZ X[b] [40 CFR 264.178] residues from containment systems. Although the X[b] treatment facilities and thermal system are not considered containment systems, this closure requirement will be considered RAR.
Action: Pump and Treat RCRA Design and operating standards for tank systems. GW, VZ X[b] [40 CFR 264.190-192] Tank systems may be used for pump and treat X[b] alternatives. RCRA Design, monitoring, and performance standards for GW, VZ X[b] [40 CFR 264.601-602] miscellaneous treatment units. X[b] Land Disposal Restrictions Any waste placed in land-disposal units must comply GW, VZ X[b] (LDRs) RCRA with LDRs by either attaining specific performance X[b] [40 CFR 268] or technology-based standards. This is applicable to untreated soil or debris from the CERCLA cleanup.
Action: Thermal Treatment RCRA These regulations apply to owners or operators of VZ X[b] [40 CFR 265.373-381] facilities that thermally treat hazardous waste in devices other than enclosed devices that use controlled flame combustion.
Action: Transportation Transportation of Hazardous Transporters must be licensed hazardous waste GW, VZ X[b] Waste RCRA haulers. In the event of a discharge during X[b] [40 CFR 263] transportation, the transporter must take immediate action to protect human health and the environment (263.30) and clean up the discharge such that it no longer presents a hazard (263.31). Generated waste being transported to an offsite disposal facility would be subject to this requirement.
Action: Reinjection of Treated Ground Water Safe Drinking Water Act These regulations consist of inventory and GW, VZ X[b] Underground Injection monitoring requirements for reinjected ground X[b] Control Program water. [40 CFR 144.26-27] [40 CFR 146.51-52]
Action: Discharge of Treatment System Effluent Clean Water Act (CWA) Both onsite and offsite discharges from CERCLA sites GW, VZ X[d] [33 USCA 1251-1376] to surface waters are required to meet the substantive X[d] National Pollutant Discharge CWA limitations, monitoring requirements [40 CFR Elimination System (NPDES) 122.41(i); 40 CFR 136.1; 40 CFR 136.4], and best [40 CFR 122-125] management practices [40 CFR 125.100].
Action: Air Stripping OSWER Directive 9355.0-28 Establishes guidance on the control of air emissions GW, VZ X[e] from air strippers used at Superfund sites for ground X[e] water treatment. This is a nonpromulgated directive and is, therefore, TBC.
General Action-Specific TBCs. DOE Order 5400.4 Prescribes conduct of operations on DOE facilities for GW, VZ X[d] compliance with CERCLA, and provides for the integration X[d] of NEPA and CERCLA documentation for DOE. This is a nonpromulgated regulation and is, therefore, TBC.
State and Local Chemical- Specific Requirements Hazardous Waste Control HCWA controls hazardous wastes from their point GW, VZ X[b] Act (HCWA) (Health and of generation through accumulation, transportation, X[b] Safety Code, Section treatment, storage, and ultimate disposal. If a chemical is either listed or tested and found hazardous, then remedial actions must comply with the hazardous waste requirements under Title 22. Porter-Cologne Water Quality Establishes authority for State and Regional Water GW, VZ X[b] Act [WC13000-13806], as Boards to determine site specific discharge X[b] administered by the State requirements and to regulate disposal of waste to Water Resources Control Board land. (SWRCB) and the Regional Water Quality Control Board (RWQCB) under CCR Title 23, subch. 15 1050-2836 State Water Resources The State Board's policy on maintaining the GW, VZ X[b] Control Board's Resolution high quality of California's waters implies that X[b] 68-16 ground water cleanup should continue below MCLs if it can be shown that it is technically feasible and cost effective to do so. 29 USC 651 et seq. OSHA requirements under 29 CFR 1910.120 are GW, VZ X[b] Occupational Safety and applicable to worker exposures during response X[b] Health Act (OSHA) actions at CERCLA sites; 29 CFR 1926 construction standards apply during construction phase of treatment facilities. 29 CFR 1910 et seq. Construction and transportation equipment noise GW, VZ X[b] Noise Control Act of 1972, levels (e.g., portable air compressors, and medium X[b] as amended by the Quiet and heavy trucks), process equipment noise levels, Communities Act of 1978 and noise levels at the property boundaries of the [40 CFR 204, 205, 211] project are regulated under this Act. State or local agencies typically enforce these levels.
State and Local Action- Specific Requirements Action: General Treatment of Hazardous Waste Hazardous Waste Control Requirements for general operations of interim GW, VZ X[b] Act, Health and Safety Code status and permitted facilities [67100-67108], X[b] (HCWA), Sections 25100-25395 including preparedness and prevention [22 CCR 67100-67195] [67120-67126], contingency plans and emergency procedures [67140-67145], and manifesting and monitoring requirements [67180-67195]. Hazardous Waste Control This law requires that certain hazardous wastes GW, VZ X[b] Act Land-Disposal meet minimum treatment standards prior to disposal X[b] Restrictions at a landfill. [22 CCR 66900] Hazardous Materials Release This law requires businesses handling hazardous GW, VZ X[b] Response Plans and Inventory materials to plan for emergency response actions. [H&SC, Div. 20, ch. 6.95] [19 CCR, ch. 3, subch. 3]
Action: Closure Hazardous Waste Control A facility shall be closed in a manner that minimizes GW, VZ X[b] Act Closure Requirements, the need for future maintenance. If hazardous X[b] Sections 25100-25395 wastes are left in place, postclosure care must [22 CCR 67210-67220] continue for 30 yearsimizes the need for future maintenance. If hazardous wastes are left in place, postclosure care must continue for 30 years.
Action: Transportation Hazardous Waste Control Hazardous wastes must be transported by a GW, VZ X[b] Act Hauler Registration hauler registered with the State of California. X[b] Requirements [22 CCR 66420-66465] and Requirements for Transporters of Hazardous Waste [22 CCR 66530-66564] Requirements for Generators Owners or operators who ship hazardous waste from a GW, VZ X[b] of Hazardous Waste Transport, Storage, or Disposal (TSD) facility shall X[b] [Title 22 66470-66515] comply with the generator standards in these regulations. These standards include keeping of manifests [66481], submission of manifest to CDHS within 30 days of shipment [66484(f)], preparation of a biennial report [66493(a)], and a maximum 90-day accumulation time [66508(a)]. These regulations are applicable to transportation and offsite disposal of hazardous waste.
Action: Discharge of Treatment System Effluent Porter-Cologne Water Quality Establishes authority for State and Regional Water GW, VZ X[b] Act [WC13000-13806], as Boards to determine site specific discharge X[b] administered by the State requirements and to regulate disposal of waste to Water Resources Control Board land. (SWRCB) and the Regional Water Quality Control Board (RWQCB) under CCR Title 23, subch. 15 1050-2836 Fish and Game Regulations Prohibits water pollution with any substance or GW, VZ X[f] on Pollution material deleterious to fish, plant, or bird life.
